1.Terms & Conditions | Balance Fitt Pilates & Yoga Studio
1.1 The company’s full trading name is Balance Fitt,
The company’s website is www.balancefitt.com, and the studio of Balance Fitt is located in Dunstable, 1 Maypole Yard Dunstable Bedfordshire LU6 2SA.
1.2 Please read these Terms & Conditions carefully before you start using our Services.
1.3 If you use our Services you agree to be bound by these Terms & Conditions (Terms).
These Terms form a legally binding contract between you and Balance Fitt., and govern your use of the Services. If you do anything to breach these Terms we hold the right to terminate your account and rescind your right to receive our Services
1.4 We may change these Terms on occasion going forward. If a revision is material we shall – at our discretion – notify you. If you continue to use our Services after any revisions take effect then you will be deemed to have agreed to the revised Terms. These Terms were last updated on 1 January 2025.
1.5 We may also change the features of our Services from time to time.
1.6 In addition to the Terms, the following additional terms apply to your use of our Services:
a. Privacy Policy;
b. Any other notices or rules outlined in our facilities.
2. Registering an account with Balance Fitt.
2.1 To register an account with Balance Fitt. you must:
a. Be an individual
b. Be 18 years old or older. If you are aged 16 or 17 you must have your parent or guardian’s written consent to register an account and must be supervised by an appropriate adult at all times when attending the studio.
c. Confirm that you have no health problems which may affect your participation in using any of our Services. In the case of any doubt, the Client shall seek advice from a doctor who should confirm your ability to exercise.
2.2 When registering an account with Balance Fitt., you must supply the following:
1. Your full name
2. A valid and active (accessible by Client) email address
3. A password for accessing your account on the website
4. Your full address
5. Details of your bank account, debit/credit card or other payment method you wish to use for purchase
2.3 By registering you confirm all information provided is true and accurate to the best of your knowledge. You must ensure the information in your account is updated regularly with any relevant changes to ensure ease of contact and communications.
2.4 We reserve the right – at our discretion – to refuse to register any given prospective user.
3. Purchasing
3.1 Purchasable offerings
3.1.1 All of the Classes we offer are outlined on the website, which can be found under 'Class Schedule'
3.1.2 You can purchase memberships, bundles or individual classes from our Website or our app. Our latest prices can be found on our Website. We reserve the right to change our prices for subscriptions and pay-as-you-go class packages from time to time at our discretion.
3.1.3 All charges for the purchase of memberships and credits are non-refundable.
3.1.4 Memberships
All Memberships are charged and activated immediately on the date of purchase, commencing that date.
All Memberships have a minimum commitment period of 3 months this includes any special offers purchased. After the initial 3-month period they can then be cancelled with 65 days’ notice provided in writing by sending an email to info@balancefitt.com. Anyone on memberships can carry over any missed classes within three weeks. You may not transfer Memberships to another user.
Pay-As-You-Go
All Pay-As-You-Go Class Pass or Bundles start from the date of first booking and have a different validity period, depending on the package.
It is your responsibility to note the duration of any Class Packages and use them accordingly as they cannot be extended, except for an injury/medical reason supported by a doctor’s note which will be at the complete discretion of management.
3.1.5 Payment for all orders processed on the Website must be made by credit or debit card on the checkout page using our payment provider Barclaycard.
You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason.
Purchases made via telephone or in-studio are subject to the same terms – we do not accept cash.
3.1.6 When subscribing, you are automatically added to our mailing list, which you can unsubscribe from after receiving your first email. Please note that all our correspondents are done via the way of email before unsubscribing.
3.1.7 PAYG Class Passes, Bundles and Memberships are non-refundable.
3.1.8 New letters, Important notices and offers will be sent out either via email, Facebook, Instagram or TikTok.
4. Memberships, subscriptions and cancelling
4.1 You will be billed every cycle (monthly) unless you choose to cancel by providing 65 days’ notice to the studio via email to info@balancefitt.com Terms & Conditions apply.
4.2 You will be automatically billed unless you cancel your membership in writing under the conditions stated above.
4.3 All memberships automatically renew until cancelled.
4.4 We may close your account if we believe that you breach any of our Terms.
5. Cancellation of classes/no-shows & late entry
5.1 All classes have a strict 6-hour cancellation policy
5.1.1 Pay-As-You-Go and Memberships
5.1.2 If you cancel 6 hours before the scheduled class start time of the class the associated credit will be returned to your account.
5.1.3 If you cancel less than 6 hours before the class start time, the credit will not be returned and cannot be refunded.
5.1.4 Unlimited Memberships
5.1.5 Three late cancellations will result in a charge of £10 this applies to all monthly memberships.
1-2-1s & Private Sessions, are subject to a 24-hour cancellation or the session will still be charged at the full rate. This can be cancelled via an email to info@balancefitt.com or via a phone call to the studio.
5.2 No-Shows
5.2.1 All Pay-As-You-Go Clients who do not show up for class will have their credit taken from their account. Monthly Memberships who do not show up to the class will lose their class, and it will not be carried over. If a client/member persistently fails to attend booked sessions, they will be considered in breach of their membership and may have their membership terminated or frozen.
5.3 Late Entry
5.3.1 No clients attending a reformer class will be permitted entry after the scheduled start time of the class. Any member who arrives after the start time of the class will not be permitted entry under any circumstances and the class credit will be taken or the fine incurred. There are no exceptions to this policy as it is in place to ensure the safety of all clients and staff and to ensure the most positive and undisturbed experience for clients taking part in the class.
First-Timers
5.3.2 First-timers for Reformer classes only must be in the studio at least 10 minutes before the start of the class for the introduction. If the safety introduction is missed the instructor may deem it unsafe for the Client to attend the session and the credit may be taken and deemed to be a late cancellation.
5.3.3 Grip socks must be worn in all Reformer classes. This is a compulsory measure to ensure safety and optimum performance for all participating in the class. If you do not have any grip socks, they can be bought once you arrive at your class. If you do not wear grip socks you will not be allowed to attend the class and will be charged or lose your credit for the late cancellation.
6. Limitation of Liability
6.1 In consideration of Balance Fitt. accepting a person as a Client, the Client agrees that:
6.1.1 Neither Balance Fitt., nor its employees or agents shall be liable for any loss, damage or theft of any property (including bicycles) belonging to, or brought onto or left outside Balance Fitt premises by the Client or any guest of the Client.
6.1.2 Any contents locked up on or outside Balance Fitt. premises are left at the owner's risk and Balance Fitt will accept no liability for loss, damage or theft in respect thereof. Balance Fitt does not offer customer parking on-site, and therefore, any attempt to park close to the studio is solely at the Client’s/owner’s own risk.
6.1.3 Neither Balance Fitt. nor its employees or agents shall be liable for any personal injury or illness occurring upon Balance Fitt. premises or as a result of the use of the facilities and/or equipment provided by Balance Fitt
6.1.4 Without prejudice to condition 6.1.3, it is the Client’s responsibility to ensure that, in accordance with our Terms and Conditions, their physical condition is appropriate for participating in Classes and to ensure that they correctly operate or use any facilities and/or equipment provided by Balance Fitt., including the adjustment of levels or settings on any equipment. If the Client is in any doubt as to how to correctly operate any equipment, they should consult a member of staff before use.
7. Recommend a Friend
It the event you recommend a friend who signs up for a monthly subscription for a minimum of three months you will be credited with £10 to use against your monthly membership. Please note that it is the client's responsibility to notify us when their friend has registered so we can action this offer.
8. Closure and Missed Classes
Balance Fitt is closed every year over the Christmas holidays, dates vary depending on the Christmas bank holidays and all members are notified in the way of email. Balance Fitt is closed on all bank holiday dates unless you are notified otherwise.
If staff members are off for sickness or on annual leave we aim to ensure that all classes are covered, in the event we cannot find a replacement teacher we will email or text you offering you another class option and notify you that the class is cancelled. We will also aim to cover the class with the same style but this will not always be possible.
